1. About These Terms & Conditions

This Shoppingfun.com.auis a shopping website where you can browse, select and order products advertised on the Site from Zada Trading (ABN 82 738 395 470). In these Terms and Conditions “we” and “us” mean Zada Trading and “you” means you the customer.

Please read these terms and conditions before accessing or using the Site. If you are under 18 years of age, then you must obtain your parent or guardian’s consent before accessing and using the Site.

These Terms and Conditions together with your Order constitute the entire Contract between us and you for the supply of Products. The Contract cannot be varied unless we agree to vary it in writing or by email.

This agreement is governed by the laws of New South Wales, Australia. Each party submits to the non-exclusive jurisdiction of the courts of that place.

2. Registration

Registration is not required to shop with us, but is optional if you wish to make repeat purchases quickly and easily. However, you need to provide some detail such as your name and your address for delivery. You warrant that all information and data provided by you in the customer application is accurate, complete and up to date. You must promptly inform us if there is a change to this information or data.

Any personal information that you give us will be held and used by us in accordance with our privacy statement. You may update, edit or terminate your account at any time through the Site.

If you choose to use a workplace email address for your account or to access the Site, then you are solely responsible for ensuring that you comply with the rules, policies or protocols that apply to the use of your email address and your workplace facilities.

3. Australia Sales

We sell and ship Products within Australia. Outsider(s) of Australia would like to place an order, please do not hesitate to contact us.

4. Prices and GST

All prices listed are in Australian Dollars and include GST.

Shoppingfun.com.au always seeks to list Products with the most competitive prices.

The purchase price of each Product is shown on the product list on the Site at the time you place your order. The purchase prices on the Product List will not necessarily be the same or correspond to the prices in Your local Zada Trading stores for the same Product.

The price of products shown excludes shipping costs. Shipping cost is shown separately on the product page but may be recalculated based on how many and what items you place in your shopping cart.

You acknowledge that we are not required or obliged to match any prices for any Products, including matching any prices for a Product that is available through our stores or vice versa; and

Shoppingfun.com.au reserves the right to change prices for Products displayed at our website at any time. Subject to these terms and conditions, once we have accepted your order, we will not change any prices that apply to the Products in that order.

5. Placing An Order

Liquor and/or Cigarettes will not be sold/delivered to any person under the age of 18 or that appears to be under the age of 18 or appears to be intoxicated. Photo ID may be requested on delivery or picking up in store. Shoppingfun does not accept any liablility for loss or damages of orders collected by a third party. All additional charges by a third party/courier are at the expense of the customer.

Shoppingfun.com.au aims to include in the Product List up-to-date pictures of the goods. At times, the picture of the goods on the Product List may differ from the goods actually supplied to you. Shoppingfun.com.au does not warrant the accuracy of the information contained in the Product List and recommends that you read the labels on Goods carefully before consuming the goods.

You may order Products by selecting and submitting your order through the Site in accordance with these terms and conditions.

Any order placed through this Site for a Product is an offer by you to purchase the particular Product for the price notified (including the delivery and other charges and taxes) at the time you place the order. We will notify you that your order is being processed by sending you an Order Confirmation and tax invoice via email; however, we do not formally accept your offer until your order has passed our internal validation procedures for verifying the bona fides of each order placed, for the purpose of preventing credit card or payment fraud.

Zada Trading and its affiliates reserve the right to  to accept or reject service, terminate accounts, remove or edit content, or cancel orders in their sole discretion, including if the requested Product is not available, if there is an error in the price or the product description posted on the Site or in your order. We will confirm acceptance of your order when we send you an email confirming shipment of the goods you have ordered. If we cannot process or accept your Order after payment is received we will contact you by email or telephone.

We may ask you to provide additional details or require you to confirm your details to enable us to process any orders placed through the Site.

You agree to provide us with current, complete and accurate details when asked to do so by the Site.

6. Payment Methods and Processing

We currently accept the following credit cards:

– Visa & Visa debit;

– MasterCard & MasterCard debit;

– AMEX (American Express).

Payment processing will not begin until we receive all the information we need.

Orders placed on a weekend or a Public holiday will not begin payment processing until the next business day.

Business days are Monday through Friday, excluding NSW Public holidays.

We process credit card payments after you click the “Submit My Order” button.

For credit card payments we will email a tax invoice to you with your Order Confirmation. Where you pay by Bank Transfer a tax invoice will be sent to you via email after your payment has been confirmed. Your tax invoice is your proof of purchase.

7. Supply Of Your Products

Subject to these Terms and Conditions, we will supply to you the Products indicated on your Order Confirmation.

When your Order items have been dispatched, we will email you to confirm shipment of each item including a tracking number for each item.

8. Restricted Products

8.1 We process and deliver all orders of liquor products from our licenced premise.

8.2You acknowledge that it is against the law to sell or supply alcohol or tobacco products to, or obtain alcohol or tobacco products on behalf of, a person under the age of 18 years.

9. Delivery Of Your Products*

* Please note:  Alcohol/Liquor Products are shipped within Australia Only.

9.1 Delivery time takes up to 2 working days from the date your payment is received. Please note that Bank Transfer payments take 1-2 business days to process.

9.2 Shoppingfun.com.au makes every effort to deliver your Product. The estimated delivery times are in business days (Monday through Friday) excluding Public holidays. The estimated ship times may change due to changes in supply or circumstances beyond our control. If your Goods has not arrived after the estimated delivery time, please contact us.

9.3 You also agree to provide us with complete and accurate information that we ask you to provide to enable us to fulfil your order that we have accepted . Shoppingfun.com.au cannot be held responsible for incorrectly entered delivery addresses.

9.4We may require your photographic identification if your Order contains Restricted product(s).

9.5 We will deliver the Products to the front door at the relevant Delivery Address. If you ask us to deliver inside a premise or building at the Delivery Address and we agree to do so, then you are responsible for all loss or damage suffered by us in connection with our delivery of the Products beyond the front door of the Delivery Address.

9.6 If you are not at the Delivery address, you acknowledge and agree that any person at the Delivery Address who receives the Products is authorised by you to receive your order. We will require a proof of that person’s identity (including photographic identification) and, where relevant, age (for example, above 18 years old to receive Restricted products). If no-one is available to take delivery of your Goods, our carrier (Australia Post eParcel) will leave a card so you can pick-up your Product from your local Post Office. Where delivery is by our courier service and no-one is available to take delivery, they will leave a card requesting you to telephone them to arrange a suitable time and date for delivery.

10. Returns

The customer is responsible for inspecting the Goods for fault and notifying us within 5 working days of receiving the Goods should there be a fault.

If the Good is damaged it may be exchanged for the same Good in store within 5 days of receiving the Goods. Otherwise return shipping can be arranged at the expense of the customer. Delivery time will be the same as the original purchased Good.

If you wish to return a Product that was provided to you under these terms and conditions, then you may request for us to collect the Product (at an additional charge that we will notify you at that time).

You must provide us with the invoice we issued to you for your order to make a claim under this clause. If you fail to do so, then we may reject or deny your claim.

Shoppingfun.com.au will not provide a refund or replace a Good that has been misused, mishandled or incorrectly installed or serviced. It is the responsibility of the customer to ensure that all instructions and advice or warnings given by the manufacturer are followed.

11. Cancelling an order

We may cancel any part of an order (including any orders that we have accepted) without any liability to you for that cancellation at any time if:

– The requested Products in that order are not available; or

– There is an error in the price or the product description posted on the Site in relation to the relevant Product in that order; or

– That order has been placed in breach of these terms and conditions.

If we do so, then we will endeavour to provide you with reasonable notice of that cancellation, and will not charge you for the cancelled order if we cancel it before the delivery date or if you are not at fault or in breach of these terms and conditions.

You may cancel an order (whether it is accepted by us or not):

– If notified before products have been dispatched, then no fees or charges will apply to that cancellation; and

– If products have been shipped, ShoppingFun.com.au reserves the right to refuse order cancellation or charge a cancellation fee should we be able to request the return of the package from our delivery service, plus 15% of restocking fee.

12. Liability

We will not be liable for any loss of income, loss of profits, loss of contracts, loss of data or for any indirect or consequential loss or damage of any kind howsoever arising and whether caused by tort (including negligence), breach of contract or otherwise.

Our maximum aggregate liability for any Product supplied to you whether in contract, tort (including negligence) or otherwise shall in no circumstances exceed the amount payable by you to us in respect of the Product(s) in question.

Nothing in these terms and conditions is intended to limit or exclude any liability that cannot be excluded by law.

13. Your general obligations 


– warrant that all information and data provided by you to us through the Site (including as part of the customer registration process) or otherwise is true, accurate, complete and up to date; the person receiving the Products at the Delivery Address is authorised by you to do so; and you have and will comply with all relevant laws relating to your use of the Site and your placement of any order to us.

– take responsibility for the safekeeping of your user name and password. You are liable if your user name and password are used by an unauthorised person. You must notify us on through our website Shoppingfun.com.au during Contact Hours if you are or become aware that there is or has been an unauthorised use of your LoginID and password or account, or any other security breach relating to your account;

– promptly advise us of any changes to your information provided to us as part of the customer registration process;

– are responsible for any costs associated with your access to or use of the Site, including Internet access fees;

– agree that we may charge you for all Products that we agree to supply to you that have been ordered using your LoginID and password through the Site.

– agree that you access and use the products and services made available at those sites solely at your own risk.

– agree that we may store, process and use data collected from your Order Form for the purposes of processing your Order by the time you palce an order. You may obtain a copy of the data held by us concerning you on request in writing. We reserve the right to charge an administration fee for processing such request. If any data held by us concerning you is incorrect, we will correct it on your written request. Please refer to our Privacy Statement.

14. General Restrictions

You must not:

– make fraudulent or speculative enquiries, purchases or requests through the Site;

– use another person’s details without their permission or impersonate another person when using the Site;

– post or transmit any obscene, indecent, inflammatory or pornographic material or any other material that may give rise to civil or criminal proceedings;

– tamper with or hinder the operation of the Site;

– knowingly transmit any viruses, worms, defects, trojan horses or similar disabling or malicious code to the Site;

– use any robot, spider, site search and retrieval application or other mechanism to retrieve or index any portion of the Site;

– modify, adapt, translate or reverse engineer any portion of the Site;

– remove any copyright, trade mark or other proprietary rights notices contained in or on the Site;

– reformat or frame any portion of the web pages that are part of the Site;

– create accounts by automated means or under false or fraudulent pretences;

– use the Site to violate the security of any computer or other network or engage in illegal conduct;

– use the Site other than in accordance with these terms and conditions; or

– attempt any of the above acts or engage or permit another person to do any of the above acts.

15. Credit Card Fraud

Whilst Shoppingfun.com.au employs the latest in Secure Sockets Layer (SSL) technology software for its transactions with our customers, Shoppingfun.com.au will not be responsible for any damages, consequential losses (whether direct or indirect) suffered by a customer whose credit card is fraudulently used or is used in an unauthorised manner.

17. Changes to These Terms and Conditions

Shoppingfun.com.au reserves the right to change the Terms and Conditions of sale at any time, and such modifications will be effective as soon as they are posted. By continueing to use the Site after these terms and conditions have been modified, you agree to be bound by the changes to these terms and conditions. If you have a order that has been accepted by us, the terms and conditions that will appy to the order, are the terms and conditions that applied at the time you placed your order.
